1. Introduction

This Data Collection Disclosure and Privacy Policy ("Policy") describes how KasbyIQ, LLC, a Utah limited liability company ("Company," "we," "us," or "our"), collects, uses, processes, stores, and shares information obtained through the KasbyIQ analytics platform (the "Platform").

The Platform facilitates the collection of structured survey data from real estate agents and real estate brokerages for the purpose of generating compatibility analytics, including a proprietary "Fit Score."

By accessing the Platform or submitting information, you acknowledge that you have read and agree to this Policy.

2. Categories of Information Collected

We collect information from (a) real estate agents and (b) real estate brokerages.

2.1 Real Estate Agent Information

We may collect:

  • Professional and career information (e.g., licensing history, production data, business model)
  • Behavioral, psychographic, and performance-related data based on structured survey responses
  • Qualitative, open-text responses
  • Longitudinal survey data collected over time
  • Platform usage and interaction data
  • Internal unique user identifiers

2.2 Brokerage Information

We may collect:

  • Organizational structure and operational characteristics
  • Environmental and cultural attributes of the brokerage
  • Survey responses aligned with the same assessment dimensions used for agents
  • Updates reflecting material operational changes

3. Method of Collection

Information is collected through:

  • Digital surveys administered via the Platform
  • Account onboarding processes
  • Periodic follow-up or longitudinal assessments

Data is stored in secure systems and associated with internal identifiers.

4. Purpose of Data Use

We use collected data for the following purposes:

4.1 Compatibility and Fit Scoring

To calculate a proprietary compatibility score between an agent and brokerage environment.

4.2 Insights and Recommendations

To generate analytics, coaching recommendations, and performance guidance.

4.3 Longitudinal Analysis

To track changes in compatibility and performance over time.

4.4 Product Development

To design, train, refine, and improve:

  • Analytical models
  • Algorithms
  • Platform functionality

4.5 Research and Benchmarking

To develop aggregate insights regarding industry trends and behavioral patterns.

4.6 Commercial Use of De-Identified Data

We may use, license, transfer, or commercialize aggregated and de-identified data, including in connection with research initiatives, data products, and strategic transactions. Any such use will not identify individual participants.

5. Data Ownership and Intellectual Property

All data collected through the Platform is subject to the following:

  • Participants retain rights to their raw submitted information

Company owns all rights, title, and interest in:

  • Aggregated data
  • De-identified datasets
  • Analytical outputs
  • Scores, models, and derived insights

No participant acquires any ownership rights in the Platform's scoring methodologies, algorithms, or outputs.

6. Data Access and Platform Visibility

The Platform uses a structured and limited access model:

Brokerages may access:

  • Fit Scores
  • Dimension-based performance indicators
  • Coaching recommendations
  • Completion metrics

Agents may access:

  • Their own performance insights and dimension-level analytics

Restrictions:

  • Raw survey responses are not shared between participants
  • Certain outputs and classifications are intentionally withheld

7. Data Sharing and Disclosure

We do not sell personally identifiable information.

We may disclose information under the following circumstances:

  • To service providers assisting with Platform operations
  • To comply with legal obligations or lawful requests
  • In connection with mergers, acquisitions, financing, or asset transfers
  • In anonymized or aggregated form for research and commercial purposes

8. De-Identification and Aggregation

We use commercially reasonable efforts to:

  • Remove identifying information
  • Aggregate data to prevent identification
  • Limit the risk of re-identification

Recipients of de-identified data are contractually prohibited from attempting to re-identify individuals.

9. Data Retention

We retain data:

  • For as long as necessary to operate the Platform
  • To support longitudinal analysis and model integrity
  • As required by applicable law

Agent data may persist across brokerage affiliations to maintain continuity of analysis.

10. Data Security

We implement administrative, technical, and physical safeguards designed to protect data, including access controls, secure storage systems, and encryption where appropriate.

No system is completely secure.

11. Participant Rights

Subject to applicable law, participants may have the right to:

  • Access their data
  • Request correction of inaccurate information
  • Request deletion (subject to legitimate business needs)
  • Withdraw consent for future participation

12. Algorithmic Limitations and Disclaimers

The Platform generates predictive and analytical outputs based on self-reported data and statistical modeling.

The Company does not guarantee:

  • Performance outcomes
  • Career success
  • Retention or business results

Outputs are informational and should not be relied upon as the sole basis for business or employment decisions.

13. No Employment or Agency Relationship

The Platform does not:

  • Make employment decisions
  • Establish agency relationships
  • Provide legal, employment, or psychological advice

All Platform outputs are advisory in nature.

14. Sensitive Data and Profiling

The Platform processes behavioral and psychographic inputs solely for compatibility analysis.

The Platform does not:

  • Diagnose mental health conditions
  • Evaluate protected characteristics

15. Data Use Flexibility and Future Applications

Data may be used for future purposes reasonably related to:

  • Product development
  • Advanced analytics
  • Artificial intelligence and machine learning systems

Such uses will continue to comply with this Policy, including de-identification standards.

16. Business Transfers

Information, including de-identified datasets, may be transferred in connection with mergers, acquisitions, asset sales, or corporate reorganizations. This Policy will continue to apply to such data.

17. Changes to This Policy

We may update this Policy periodically. Continued use of the Platform constitutes acceptance of the updated Policy.
